This significant ruling, issued on January 16, 2026, dismisses appeals filed by Western Coalfields Limited and employees of VIPL, who had challenged the plan's approval.
The NCLAT's two-member bench confirmed the earlier decision by the National Company Law Tribunal (NCLT) Mumbai bench, which had approved Adani Power's plan on June 18, 2025. The tribunal concluded that the appeals lacked merit and found no violations of the Insolvency and Bankruptcy Code (IBC) provisions. The NCLAT further stated that the resolution plan was compliant with all statutory requirements and that the Committee of Creditors (CoC) had exercised proper commercial discretion in a fair and lawful manner.
